Scaffolding: Terms and Conditions
Standard Conditions to erect and maintain scaffolding, hoarding and/or other structures.
Legislation: The Highways Act 1980: Sections169 and 172
1) Non-refundable Fee
(i) £113.00 up to 10 metres in length - per scaffold, hoarding, and/or other structures (period up to 2 months)
(ii) £131.00 between 10 and 50 metres - per scaffold, hoarding, and/or other structures (period up to 2 months)
(iii) £149.00 over 50 metres per scaffold, hoarding, and/or other structures (period up to 2 months)
Payment method:
- By using the self service portal and making payment with a Debit or Credit Card. Note that there will be a surcharge if paying by Credit Card.
2) Extension(s) to the licence (non-refundable fee)
(i) £113.00 up to 10 metres in length - per scaffold, hoarding, and/or other structures (per consecutive month)
(ii) £131.00 between 10 and 50 metres - per scaffold, hoarding, and/or other structures (per consecutive month)
(iii) £149.00 over 50 metres - per scaffold, hoarding, and/or other structures (per consecutive month)
Payment method:
- By telephoning 01766 771000 (Galw Gwynedd) between 9:00am and 5:00pm and making payment with a Debit or Credit Card.
3) The Applicant Must:
(a) Complete the application at least 5 working days before the required commencement date of the licence.
(b) Not deposit the scaffold, hoarding, and/or other structures on the Highway until you have received the licence.
4) The Licensee Must:
(a) ensure that the structure is adequately lit at all times between half an hour after sunset and half an hour before sunrise.
(b) comply with any directions given in writing by the authority with respect to the erection and maintenance of traffic signs in connection with the structure.
(c) do such things in connection with the scaffolding, hoarding or other structure that any highway authority or statutory undertaker reasonably requests for the purpose of protecting or giving access to any apparatus belonging to or used or maintained by them.
(d) be reminded that it is their responsibility to ensure that the scaffolding or other structure, is structurally sound, is properly erected to current standards and maintained, and that adequate provision is made for the safe passage of highway users.
(e) when required, provide a convenient covered platform and handrail to serve as a footway for pedestrians where the full width of the footpath is used by the scaffold, hoarding or other structure.
(f) ensure that adequate space is left for pedestrians with pushchairs and wheelchair users.
(g) contact the Parking Unit (01766 771 000) to make the necessary arrangements if parking bays are to be affected.
(h) ensure that the structure shall be designed, erected, modified, and dismantled by suitably qualified personnel.
5) The applicant will indemnify Cyngor Gwynedd against any distresses, actions, proceedings, claims, demands, costs, damages and expenses which may be levied, brought or made against it by reason of any matter which may rise directly or indirectly as a result of this permission. The minimum Public Liability Limit of Indemnity required is £10 million.
6) Please note that if your public liability insurance expires within the term of the licence it is your responsibility to renew the insurance so that it runs concurrent with the previous policy. Proof of the renewal must be sent to Cyngor Gwynedd as soon as possible. It should be noted that if not received the licence would be deemed invalid.
7) The applicant will be held liable for any damage to the highway structure and/or Statutory Undertakers apparatus resulting from the erection, maintenance, dismantling of scaffolding, hoarding, and/or other structures on the highway and will be responsible for reimbursing Cyngor Gwynedd or its Agent for the actual costs of making good any damage caused.
8) No scaffold, hoarding, and/or other structures shall remain on the highway after the period specified on the licence. A invoice for the non-refundable fee of £113.00, £131.00, or £149.00 plus and additional £125 (per month) will be sent for any un-licensed scaffolding, hoarding, and/or other structures.
9) The highway authority or a constable in uniform may require the owner of the scaffolding, hoarding, and/or other structure to remove or reposition it or cause it to be removed or repositioned. Any expenses reasonably incurred in the removal or repositioning of the scaffolding, hoarding, and/or other structure may be recovered from the owner of the property.
10) Cyngor Gwynedd may also specify any other relevant conditions relating to the placement of scaffolding, hoarding, and/or other structure as they see necessary.
